Right-of-way is the scarcest asset in American energy.

Steel can be milled. Capital can be raised. Permits can, eventually, be won. The one input that cannot be manufactured is an assembled path across a thousand private properties.

Every linear energy asset—every pipeline, every transmission line, every conduit—rests on the same invisible foundation: a continuous chain of legal rights across land the builder does not own. The industry calls it right-of-way, and for most of the twentieth century it was treated as a routine input, assembled tract by tract by land agents at modest cost. That world is gone.

The assembly problem

A corridor is only as valuable as its continuity, which makes assembly a chain of single points of failure: one unwilling owner, one contested parcel, one changed county attitude, and a hundred-mile route becomes two useless fifty-mile fragments. Modern conditions have multiplied those failure points—land fragmentation as ranches divide across generations, organized opposition that arrives before the survey crews do, litigation that treats every crossing as a negotiation of last resort, and a permitting environment in which linear projects routinely spend years in review before the first easement is even signed.

The result is visible in every developer's budget: right-of-way and its associated delay have moved from a rounding error to a principal driver of whether linear projects happen at all. Routes that would have been assembled in eighteen months a generation ago now take five years or arrive never.

New corridors are not expensive. They are increasingly unavailable at any price. Those are different problems, and the second one is ours to solve.

Scarcity that compounds

Most scarce assets invite substitution—expensive steel invites more mills. Corridor scarcity is different, because the constraint is not economic but social and legal: more capital does not produce more willing landowners or faster dockets. Meanwhile demand for paths is growing, not shrinking—power transmission, water, fiber, hydrogen, and CO₂ transport all need linear routes through the same crowded geography. A fixed and effectively shrinking supply of assemblable paths, against a rising count of projects that need them, is the definition of an appreciating asset class.

The overlooked inventory

Here is the asymmetry LAB Midstream is built on: while new corridors have become nearly impossible to create, thousands of miles of existing corridors sit attached to pipelines that no longer earn their keep—idle systems, abandoned lines, legacy easements held by successor companies that have stopped noticing them. The rights are assembled. The surveys exist. The continuity is intact. The market prices these positions off the dead pipe inside them, not the living path they represent.

LAB Midstream acquires and holds these corridors. We are not speculating that paths will matter; the entire built history of American infrastructure says they always have. We are simply buying them from the only sellers who don't agree—at prices set by what the asset was, rather than what it is.
